Blackout-Tip
Terms of Use
An online service of Corporacion Lutz S.R.L.
Valid for the website blackout-tip.com and the content, downloads, product recommendations, donation functions and affiliate links offered there.
§1 Scope and definitions
These Terms of Use apply to the use of the website blackout-tip.com and to all content, functions, digital offers, downloads, product recommendations, donation options and affiliate links provided there.
These terms apply in particular to the following online offers:
They also apply to future subdomains, technical extensions or successor offers, provided that these expressly refer to these Terms of Use.
A user within the meaning of these Terms of Use is any natural or legal person who visits the website, reads content, uses downloads, makes a payment, donates, follows product recommendations or otherwise uses website functions.
Different, conflicting or supplementary terms of users do not apply unless we have expressly agreed to their validity in writing.
§2 Type of offer and conclusion of contract
Blackout-Tip is an information service about preparation, supplies, canning, crisis preparedness, practical everyday tips and related topics. The content is for general information only and does not replace individual professional advice.
A contract for paid digital content, downloads or other paid services is only concluded when the user fully completes the intended ordering or payment process and the payment has been successfully completed. The process usually includes the following steps:
Automatic emails, payment confirmations or system messages initially only confirm receipt or technical processing of the transaction. A claim to provision exists only after successful payment and technical release of the respective content.
For security reasons, the specific order data and payment information are not made permanently publicly accessible via the website. The user is responsible for keeping received confirmations, download links or invoice information safe.
The contract language is German unless another language is expressly offered. Translations are provided for better understanding. In questions of interpretation, the German version is authoritative.
§3 Prices, payments and donations
Where paid downloads, digital content or other services are offered on the website, the prices displayed at the time of ordering apply.
All prices are shown in the currency stated on the website. Depending on the offer, euros, US dollars or another displayed currency may be used in particular.
For paid content, voluntary support or donations, the following payment methods in particular may be offered:
There is no entitlement to a specific payment method. We may change, restrict or remove payment methods at any time insofar as this applies to future transactions.
Payments for digital content are generally due immediately. Provision takes place only after successful payment confirmation by the respective payment service provider.
Donations and voluntary support are made without any claim to a specific consideration. Unless expressly stated otherwise, these are not tax-deductible donations to a charitable organization.
§4 Provision of digital content and technical availability
Digital content, downloads, recipes, checklists or other files are provided after successful release via the website, by email, through a download link or by a comparable technical method.
No physical goods are shipped unless expressly stated otherwise for the respective offer.
The user is responsible for ensuring that their technical devices, internet connection, browser and software are suitable for accessing and using the content.
Download links may be technically, time-wise or quantitatively limited, especially for security reasons or to protect against misuse.
Permanent, uninterrupted availability of the website or individual content at all times is not guaranteed. Maintenance work, technical disruptions, server problems, security measures or external service providers may lead to temporary restrictions.
We make efforts to provide the content reliably, but we do not guarantee that the website will be accessible without errors at all times, in every location and on every device.
§5 Withdrawal, refunds and digital content
For digital content, downloads and files made available immediately, a right of withdrawal may be restricted or excluded depending on applicable law if the user expressly requests or confirms that provision should begin before a possible withdrawal period expires. Refunds are only granted where required by law or voluntarily promised by us in an individual case.
§6 Informational nature of the content
The content on Blackout-Tip is created with care, but serves exclusively as general information.
The website does not provide governmental, medical, legal, tax, safety-related, nutritional or other individual professional advice.
Information about blackouts, stockpiling, canning, hygiene, energy, water, safety or emergency preparation can differ significantly depending on country, region, personal situation, health condition, living environment and current circumstances.
Users must independently check whether a tip, recipe, product, method or download is suitable for their specific situation.
In case of doubt, the competent authorities, medical professionals, qualified advisory bodies, food and hygiene specialists or other suitable professionals should be contacted.
§7 Recipes, canning, supplies and food safety
Recipes, canning instructions, supply tips and information on food storage are provided to the best of our knowledge, but cannot replace a personal assessment of the specific circumstances.
Canning, fermenting, preserving, storing and reusing food involve risks if hygiene, temperature, ingredients, acidity, cooking time, containers, storage conditions or other factors are not observed correctly.
The user is responsible for using only proper ingredients, maintaining clean working conditions, using suitable jars and equipment and not consuming spoiled, swollen, unusually smelling or unsafe-looking food.
Information on shelf life, quantities, cooking times, portions, storage or supply planning is intended as guidance and may vary depending on environment, climate, equipment and personal implementation.
We accept no responsibility for damage, illness, food spoilage or other consequences caused by improper implementation, incorrect storage, unsuitable ingredients, lack of hygiene or individual intolerances.
§8 Downloads, product recommendations, affiliate links and donations
Blackout-Tip may offer free and paid downloads, checklists, guides, product recommendations, external links, affiliate links and voluntary support options.
Digital downloads
Downloads may include checklists, guides, templates, overviews, recipe documents or comparable digital content.
The purchase or retrieval of a download entitles the user to private use unless expressly stated otherwise.
Passing on, publishing, reproducing, commercial use or resale of downloads is not permitted without express written consent.
We do not guarantee that a download is fully suitable for every personal, technical, legal or regional situation.
The user is responsible for safely storing downloaded files and protecting them from loss, unauthorized access or technical damage.
Product recommendations
Product recommendations on Blackout-Tip are intended for orientation and do not constitute binding purchase advice.
Before buying a product, the user must independently check whether the product is suitable for its purpose, place of residence, technical equipment, legal framework and personal situation.
Product prices, availability, delivery conditions, technical data, reviews and properties may change at any time.
Only the information provided by the respective retailer, manufacturer or provider at the time of purchase is authoritative.
The respective provider is solely responsible for products, deliveries, guarantees, warranties, returns or damage related to third-party products.
Affiliate links
The website may contain affiliate links. If a user buys a product or performs an action via such a link, we may receive a commission.
This usually does not create additional costs for the user unless the respective provider states otherwise.
Affiliate links do not automatically influence the editorial assessment of a product. Nevertheless, there may be an economic interest in the referral.
A purchase contract is concluded exclusively between the user and the respective external provider.
We are not a party to such purchases and accept no responsibility for delivery, product quality, warranty, returns, support or price changes.
Users should independently check external offers, product information and retailer terms before making a purchase.
Donations and voluntary support
Donations and voluntary support serve to finance, maintain and further develop Blackout-Tip.
A donation does not create any claim to a specific consideration, preferential treatment, publication, advice, delivery or permanent availability of specific content.
§9 Liability and responsibility of the user
The use of the content is at the user’s own responsibility. Blackout-Tip provides general information, but does not guarantee individual results.
General limitation of liability
We are liable only for damages based on intentional or grossly negligent conduct, to the extent permitted by law.
In cases of simple negligence, we are liable only for breach of essential contractual obligations and only for foreseeable damages typical for the contract.
Liability for indirect damages, consequential damages, lost profits, data loss, loss of use or other indirect disadvantages is excluded to the extent permitted by law.
Mandatory statutory liability, in particular for intentional conduct, gross negligence or injury to life, body or health, remains unaffected.
The limitations of liability also apply in favor of our employees, vicarious agents, technical service providers and other commissioned persons.
No guarantee for crisis preparedness and blackout situations
Blackout-Tip cannot guarantee that a user is sufficiently prepared in the event of a power outage, blackout, crisis or other emergency situation.
Every crisis situation can develop differently and depend on factors outside our control.
These include in particular the duration and extent of a power outage, water supply, medical situation, weather, housing situation, family circumstances, legal requirements and regional infrastructure.
Our content is help and food for thought, but not binding instructions for specific emergencies.
Users must give priority to official warnings, orders from authorities and current information from competent bodies.
Personal responsibility when applying the content
The user decides independently whether and how to implement recipes, checklists, product recommendations, supply tips, safety measures or other information.
Before application, personal requirements, health condition, available equipment, place of residence, climate, legal framework and practical feasibility must be checked.
In case of uncertainty, content must not be adopted blindly.
This applies especially to food, drinking water, fire, gas, electricity, batteries, generators, medication, first-aid measures and safety-relevant equipment.
Children, older people, sick persons, pregnant women, pets or other particularly vulnerable persons may have additional requirements.
Blackout-Tip accepts no responsibility if users misunderstand information, implement it incompletely or transfer it to unsuitable situations.
Responsibility for preparation, purchasing, storage, application and control lies with the user.
External providers, products and services
Where Blackout-Tip refers to external providers, products, shops, platforms, videos, maps, payment service providers or other third-party offers, the terms of the respective third-party provider apply.
We have no influence on prices, availability, delivery times, product quality, product changes, safety information or legal permissibility of external offers.
We accept no responsibility for damages, defects, delivery problems, incorrect product information, payment problems or other disadvantages arising from contracts with third-party providers.
Users must independently check external offers before use or purchase.
This applies especially to safety-relevant products such as gas stoves, generators, batteries, power stations, water filters, lamps, heaters or medical equipment.
Mention of a product or provider does not mean a guarantee, certification or official recommendation.
In case of doubt, manufacturer information, operating instructions, safety data sheets, local regulations and professionals must be given priority.
§10 Copyright and usage rights
All content, texts, images, graphics, logos, recipes, downloads, checklists, layouts and other materials published on Blackout-Tip are protected by copyright or other rights unless expressly marked as third-party content.
Use of the website is permitted only within the scope of these Terms of Use and applicable laws.
Users may read, save or print content for private use where this is technically provided.
Publication, passing on, editing, translation, reproduction, systematic storage, commercial use or public accessibility is not permitted without express written consent.
This applies in particular to paid downloads, checklists, guides, images, graphics, recipes and structured content.
Removing copyright notices, logos, source references or other markings is not permitted.
In the event of violations, we reserve the right to take legal action, block access and claim damages.
For content, messages or files submitted by the user, Blackout-Tip receives only the rights necessary to process the respective request or perform the required technical steps.
§11 Duties of users
Users undertake to use the website only lawfully, properly and without misuse.
In particular, it is prohibited to:
- circumvent technical protection measures, download limits, payment processes or security functions;
- automatically read, copy, redistribute content or use it for third-party databases;
- impair the website, forms, payment functions, servers, email systems or other users through spam, malicious code, attacks or other abusive actions;
Users must provide truthful and complete information in forms, payments, donations or other entries where this is required for the respective function.
In the event of violations, we may block access, deactivate downloads, reject requests, remove content or examine further legal steps.
§12 Data protection
Information on the processing of personal data is provided in our Privacy Policy.
It explains which data may be processed when visiting the website, using contact forms, payments, downloads, donations, emails or technical security measures.
External payment service providers may be used for payments. The privacy and terms of use of the respective service provider also apply.
For external links, shops, platforms, videos, maps, social networks or other third-party offers, the privacy policies of the respective providers apply.
Users should not transmit sensitive personal data if this is not necessary for the respective request or function.
The website uses technical and organizational measures to protect data appropriately. However, completely risk-free data transmission over the internet cannot be guaranteed.
Where legally required, consent is obtained or statutory information obligations are fulfilled.
Further details can be found in the current Privacy Policy of Blackout-Tip.
§13 External links and third-party content
Blackout-Tip may contain links to external websites, shops, platforms, videos, maps, official websites, information services or other third-party content.
The respective operators are solely responsible for the content, availability, timeliness, security, data protection, prices, products or services of external providers.
At the time of linking, we check external content only within reasonable limits. Permanent monitoring of external offers is not possible without a specific reason.
If we become aware of unlawful, dangerous or obviously incorrect content, we will remove or adjust the relevant links after review.
Clicking on external links is at the user’s own responsibility.
§14 Changes to the website and Terms of Use
We may change, add, restrict or remove content, functions, prices, downloads, product recommendations, technical processes or individual areas of the website at any time.
There is no claim to permanent provision of specific free content or functions.
These Terms of Use may be amended if legal, technical, economic or content-related conditions change.
The version published at the time of use applies to the use of the website.
§15 Communication and contact
Requests may be submitted using the contact options stated on the website.
We strive to process requests promptly, but do not guarantee a specific response time.
Submitted messages must be factual, lawful and free of malicious code, spam or abusive content.
For questions about specific emergencies, medical problems, acute dangers or official measures, Blackout-Tip is not the correct contact; the relevant emergency number, authority or specialist body should be contacted.
Email communication may be technically insecure. Users should not send confidential or sensitive information by email if this is not necessary.
Automatic emails, confirmations or system messages may be delayed for technical reasons or blocked by spam filters.
§16 Final provisions
The law of the Dominican Republic applies, unless mandatory consumer protection provisions conflict with this.
The place of jurisdiction, where legally permissible, is the registered office of Corporacion Lutz S.R.L.
Mandatory statutory rights of consumers remain unaffected.
If individual provisions of these Terms of Use are invalid, unenforceable or incomplete, the validity of the remaining provisions remains unaffected.
Translations of these Terms of Use into other languages are provided for understanding. In case of interpretation differences, the German version is authoritative.
Instead of an invalid or unenforceable provision, the legally permissible rule that comes closest to the economic and legal purpose of the original provision shall apply.
